Inspired Minds Early Learning Centre and Cottage — Terms & Conditions

Welcome to Inspired Minds Early Learning Centre. These Terms & Conditions (“Terms”) govern your use of our website and the provision of early education and care services at 51 & 53 Manning St, Tuncurry NSW 2428. By accessing our site or enrolling your child, you agree to comply with these Terms, the Education and Care Services National Law (NSW), the Education and Care Services National Regulations, the National Quality Standard, the Privacy Act 1988 (Cth) and the Australian Consumer Law.

1. Definitions

“Centre” means Dolphins Childcare Centre Pty Ltd (ABN xx xxx xxx xxx).
“You”/“Parent/Guardian” means the legal guardian enrolling a child.
“Child” means any child aged 6 weeks to 5 years enrolled at the Centre.
“Services” mean early education and care, including before-/after-school and vacation care where offered.

2. Acceptance of Terms

1. By using our website or enrolling your Child, you warrant you have authority to agree to these Terms.

2. If you do not agree, do not use our site or attend our Centre.

3. Eligibility & Enrolment

1. Services are available to Children aged 6 weeks–5 years.

2. Parents/Guardians must submit a completed Enrolment Form via our website or in person, including accurate medical, dietary and emergency-contact details.

3. You must provide all supporting documentation (e.g. immunisation records) before your Child’s first day.

4. Fees & Payment

1. Fees accepted as part of the enrolment process form part of these Terms.

2. Payment — all fees are payable in advance by the due date (typically the 1st of each month), via direct debit, credit card or as otherwise agreed.

3. Late payment: overdue accounts incur a late fee of up to 10%. Accounts unpaid 30 days past due may lead to temporary suspension.

4. Child Care Subsidy (CCS): where applicable, you must submit CCS details to Services Australia and pay any gap fees by the due date.

5. Cancellations & Refunds

1. Stand-down & Withdrawal: 30 days’ written notice is required to cancel permanent bookings.

2. Casual/Drop-in: paid in advance; fees are non-refundable.

3. Illness/Holidays: fees are not refundable for absences due to illness or holidays.

6. Service Provision & Conduct

1. We aim to provide a safe, nurturing environment following the Early Years Learning Framework.

2. We reserve the right to refuse or withdraw care if your Child’s behaviour poses a risk to themselves, others or staff.

3. All Children must comply with the Centre’s policies (e.g. behaviour management, sun safety, nutrition).

7. Health & Safety

1. You must inform us immediately of any changes to your Child’s health, allergies or medical conditions.

2. Contagious Illnesses: Children displaying symptoms of contagious disease must not attend. We may send a Child home at our discretion.

3. Medication: must be handed to staff with a completed Medication Authority form.

8. Liability & Insurance

1. Dolphins Childcare Centre carries public liability and professional indemnity insurance as required by law.

2. To the extent permitted by the Australian Consumer Law, we exclude all liability for loss, damage or injury, except where caused by our gross negligence or wilful misconduct.

9. Privacy

1. We handle your personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).

2. We will not disclose your information to third parties, except where required by law or necessary to provide CCS.

10. Intellectual Property

All content on our website is owned or licensed by Dolphins Childcare Centre. You may not copy or reproduce without our written consent.

11. Changes to Terms

We may update these Terms at any time. Revised Terms will be published on our website with a new “Last updated” date. Continued use of our site or Services constitutes acceptance.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. Any dispute must be litigated in the courts of New South Wales.
