Inspired Minds Community - Terms and Conditions

  • 1. Interpretation

    In these Terms and Conditions:

    • "Company" means Inspired Minds (Australia) Pty Limited. ABN 48 128 762 452
    • "GST" means Goods and Services Tax
    • "Member" means a member of the Inspired Minds Community
    • "Inspired Minds Community" means the Inspired Minds (Australia) Pty Limited membership community
  • 2. Membership
  • 2.1 General
  • 2.1.2 Membership of the Inspired Minds Community is:
    • Open to individuals or organizations
    • Open to individuals under the age of 18, providing the individual has accepted the terms and conditions outlined here.
    • Governed by these terms and conditions
    • Is not transferable
  • 2.1.3 The Company, may at its discretion, refuse an application for membership of the Inspired Minds Community
  • 2.1.4 The Company will maintain strict privacy on the Member's personal details and shall comply with the Company's Privacy Policy.
  • 2.1.5 If a member provides a testimonial about the Inspired Minds Community to the Company, the Company may use the testimonial, in part of whole, to promote the Inspired Minds Community in any format or medium at any time.
  • 2.2 Membership Benefits
  • 2.2.1 The Company shall provide the following benefits to Members:
    • A welcome kit for each new Member
    • A monthly pack with either /or goods and services
    • Other benefits from time to time
  • 2.2.2 The Company may from time to time provide the following additional benefits to Members:
    • Hosting of Inspired Minds Community events
    • An opportunity for Members to participate in the Inspired Minds online community.
  • 2.3 Membership Fees
  • 2.3.1 Each month Members are required to pay the monthly membership fee to the Company in advance.
  • 2.3.2 The Company may increase the monthly membership fee from time to time, provided that Members are given at least one month's notice of the increase.
  • 2.3.3 Payment of the monthly membership fee can only be made by one of two methods
    • A direct debit authority
    • From a credit card account nominated by the Member to the Company from time to time.
  • 2.3.4 A Member authorizes the Company to deduct the monthly membership fee from the nominated credit card account or direct debit authority each month during their membership. This authorization shall continue until the expiration of the one-month period of notice given by a member when terminating their membership.
  • 2.3.5 Until increased in accordance with clause 2.3.2, the monthly membership fee is: AUD35.95 per month plus AUD5.95 Postage and Handling (inclusive of GST) What about outside NSW or International?
  • 2.3.6 Each Member agrees to promptly notify the Company of any changes to any of the information supplied in relation to membership, including but not limited to changes to credit card and contact details. Failure to do so may prevent or delay the provision of goods and services by the Company to the Member.
  • 2.3.7 Goods and Services will not be provided to a Member in any month where the Members monthly membership fee is not paid in that month.
  • 2.3.8 Membership does not create any financial or other interest in the Company or in the assets of the Inspired Minds Community.
  • 2.4 Membership Termination

    The Company may immediately terminate the membership of a Member where the Member:

    • Fails to pay the monthly membership fee
    • Supplies or attempts to supply misleading information, or makes any misrepresentation to the Company
    • Acts in a way that is prejudicial or likely to be prejudicial (as determined by the Company) to the interests of the Company or other Members.
  • 2.4.2 A Member may terminate their membership upon giving the company one month's notice of their intention to do so. Does this need to be in writing? Most DD's are.
  • 3. Exclusion of Liability

    The Company is absolved from all liability to a Member however arising from economic loss, special, direct, indirect or consequential damages of any kind in any due to, resulting from or arising in connection with Member's;

    • Membership to the Inspired Minds Community
    • Receipt or non receipt of any goods and services
  • 3.1 Where goods or services are not sent to a member in a month where the membership of the Member is current the liability of the Company for that failure shall be limited to providing such goods and services subsequently.
  • 4. Release and Indemnity

    In consideration of the Company accepting their application for membership the Member:

    • Releases and forever discharges the Company from all Claims that they may have or may have had but for this release arising from or in connection with their membership of the Inspired Minds Community and /or their participation in any Inspired Minds Community activity.
  • 5. Varying Terms and Condition

    The Company may vary these Terms and Conditions at any time by advising the Member by any suitable means (as determined by the Company), including the use of the Website.
